How to notify neighbours in Tasmania

Notice of discretionary planning applications, and the protection work notice you give before building near the boundary.

Quick answer: for a discretionary application the council gives notice, unless it asks you to: a newspaper notice, an A4 sign at each public boundary and a letter to the owners and occupiers of all adjoining properties. People have 14 days to make a representation. Before protection work, you serve a notice on each adjoining owner, who has 21 days to respond.

Protection work notices

  • Before protection work, the owner must notify each adjoining owner, the building surveyor and, for plumbing, the permit authority (Building Act 2016 s 77).
  • The notice sets out the work, the protection work, the program and the building surveyor’s name.
  • The adjoining owner has 21 days to respond. No response counts as agreement.
  • Work cannot start until every adjoining owner has agreed or is taken to have agreed. Disagreements go to the building surveyor.
