Protection work notice to adjoining owner (TAS): free template

In Tasmania the neighbour has 21 days to respond to protection work, and work cannot start until they have agreed or are taken to have agreed.

Quick answer: Before protection work in Tasmania, the owner must notify each adjoining owner, the building surveyor and, for plumbing, the permit authority. The notice sets out the building work, the protection work, the program and the building surveyor’s name. The adjoining owner has 21 days to respond, and no response counts as agreement. Work cannot start until every adjoining owner has agreed or is taken to have agreed.

When to send it

Send it as soon as the protection work design is settled, and at least 21 days before the protection work is due to start. Copy the same notice to your building surveyor.

The rules behind it

Check with your building surveyor whether they want a particular form used. This letter covers the details the Building Act 2016 asks the notice to include. If the neighbour disagrees, the building surveyor decides. More on the Tasmanian notification rules page.

Tips that save complaints later

  • Send it to every adjoining owner, including owners of land at the back and the side, not only the house next door.
  • Keep a copy of what was sent, to whom and when. You need it to show the 21 days have passed.
  • Answer questions in writing so there is a record.
