Protection works notice to adjoining owner (NT): free template

Excavation or demolition close to the building next door means the adjoining owner hears from you before work starts.

Quick answer: In the Northern Territory, where excavation or demolition is close to an existing building, the owner must protect the adjoining property. Before work starts, notify the adjoining owner with the building work, the protection works and the certifier’s details. They have 14 days to respond, and no response counts as agreement. Disagreements go to the Director of Building Control.

When to send it

Send it once your certifier has signed off the protection works design, and at least 14 days before the work starts. Allow longer if you are posting it.

The rules behind it

The rules are in Part 9 of the Building Act 1993 and regulation 22 of the Building Regulations. Your certifier can confirm what to attach. More on the Northern Territory notification rules page.

Tips that save complaints later

  • Photograph the neighbour’s walls and paths before work starts and offer them a copy.
  • In the build-up season, plan for storms. Say what happens to an open excavation in heavy rain.
  • Keep a note of when the notice was delivered so you know when the 14 days end.
